AI Governance Isn’t the Same as AI Decision Confidence
November 10, 2025

Many legal organizations have adopted AI governance — policies, risk frameworks, acceptable-use rules. Fewer have developed AI decision confidence: the human and organizational capability to make confident, defensible decisions with AI assistance. This Insight examines the difference, and why an organization can govern AI well and still make unconfident AI-assisted decisions.
AI governance answers the question: what is AI allowed to do? AI decision confidence answers a different question: when AI has done what it is allowed to do, does the organization make a confident, defensible decision with the result? The two are related but distinct. An organization can have strong governance and weak decision confidence, because governance sets the rules while decision confidence is the capability to decide well within them.
The confusion matters because it leads organizations to believe that adopting an AI policy is the same as being ready to use AI. It is not. A policy that permits AI-assisted research does not give the organization the capability to verify that research. A policy that requires escalation does not give professionals the judgment to know when to escalate. Governance permits; confidence performs.
Governance sets the rules. Decision confidence is the capability to decide well within them.
The organizations that use AI well do both. They govern AI so its role is defined, and they develop decision confidence so the decisions AI informs are confident and defensible. Treating the two as the same leaves an organization with rules but no capability — and with AI-assisted decisions that are permitted but not confident.

What Makes an AI-Assisted Legal Decision Defensible?
A defensible AI-assisted legal decision is not one that reached the right outcome. It is one where the role of AI and the role of human judgment can be shown. This Perspective examines what defensibility requires.
