What Makes an AI-Assisted Legal Decision Defensible?

As AI-assisted legal decisions are challenged — in court, in audits, in regulatory review — the question of what makes them defensible becomes urgent. A defensible decision is not one that reached the right outcome. It is one where the role of AI, the role of human judgment, and the reasoning behind the decision can be shown. This Perspective examines what defensibility requires when AI participated in the decision.

Defensibility has always meant showing that a decision was reasonable at the time it was made, based on what was known. AI assistance changes what must be shown. A defensible AI-assisted decision must also show how AI participated: what it generated, what was verified, what was escalated, and who owned the decision the AI informed.

The organizations that will defend AI-assisted decisions successfully are not the ones that used AI least. They are the ones that can reconstruct the decision — the generated inputs, the verification performed, the judgment applied, the alternatives weighed, and the human who owned the outcome. Defensibility is not the absence of AI. It is the presence of a record.

A defensible AI-assisted decision is one where the role of AI and the role of human judgment can be shown.

The implication is operational. Every AI-assisted decision must carry the record of its own defensibility: what AI produced, what a human checked, where judgment was applied, and who was accountable. Building that record at the time of the decision is far cheaper than reconstructing it under challenge.
